Islamic jurisprudence concerns the knowledge and skills required of Muslim jurists and the etiquette they are expected to observe. These requirements and etiquette set standards for an answer being sound and acceptable to follow, and minimize the potential for errors. Just as rules of grammar protect those who follow them from mistakes in expressions, rules of logic protect those who follow them from mistakes in arguments; jurisprudence sets standards for interpreting legal texts and making legal arguments which, when followed correctly, protect from making mistakes in arriving at legal rulings.
Students of jurisprudence read through a series of texts with their instructors. One of the first books of jurisprudence taught to students is the Waraqat of Imam al-Juwayni, often with a short commentary by Jalal al-Din al-Mahalli. This translation introduces these two texts to English-speaking audiences and should serve readers as an introduction to the basic topics of jurisprudence, preparing them to study more advanced material.
About The Translator
Musa Furber was born in Massachusetts and raised in Portland, Oregon. He majored in linguistics at Portland State University, with an emphasis on computational linguistics and cognitive science, a major that required him to study a non-Indo-European language.
As good fortune would have it, Arabic was the only class that fit in his schedule at the time, thus starting him off on what eventually would become a serious and personal study of the Quran and Islam.
Musa embraced Islam and shortly thereafter embarked on a path of learning. While still a student in Portland, he studied Shafi'i fiqh with a scholar who was in Portland at the time.
After graduating from college, Musa went to Damascus to further his Arabic studies. After a one-year return to the U.S., Musa again traveled to Damascus where he completed an intensive four-year study of the traditional sciences of Islam (hadith, Quran, fiqh, advanced Arabic grammar, biography of the Prophet (peace and blessings be upon him), and more).
After graduation, he continued his studies with scholars in and around Damascus. He has studied several important texts and is qualified to translate and teach them. Later he entered and completed a prestigious training program in the issuance of legal response (fatawa) at Dar al-Ifta’ al-Misriyya, under the direct supervision of Shaykh Dr. Ali Jumu`a, the Mufti of Egypt.
After successfully completing the program and acting as an official researcher and English translator for Dar al-Ifta’, he was recruited by Shaykh Habib Ali al-Jifri to serve as a lead researcher at the Taba Insitute in UAE, where he currently resides.
